Cost and Payment Policies-Arbitration

A non refundable administrative filing fee of $250.00 per party; an hourly charge of $325.00 per hour for all time expended in the administration, pre-hearing study, hearing time and opinion time, (if requested), of a case plus any necessary expenses associated with the proceeding.

Charges are billed to the parties on a monthly basis. There is no additional charge for an Award. If an opinion is requested, it will be billed at the above stated rate.

Judge Metcalf will arbitrate in any geographical area. Travel expenses and incidental expenses, if any, for a hearing location are charged separately.

Arbitration Awards/Opinions are not released until all fees are paid in full. This includes any additional funds requested by the Arbitrator for preparation and/or opinions.

Cancellation Policies-Arbitration

Arbitration cancellation fee policy: 100% of the invoiced fee for any cancellation within 10 business days of the scheduled arbitration date. 75% of the invoiced fee for any cancellation within 11 -15 business days of the scheduled arbitration date.

Cost and Payment Policies-Mediation

All mediation fees are due before the mediation begins. Unless otherwise agreed by the mediator, each party represented by a lawyer/law firm is a considered a “separate party” and is responsible for its mediation fee. Mike reserves the right not to begin or conduct a mediation if the fees are not paid.

Preparation time Mike spends discussing the case with counsel for the parties and/or the parties, reviewing documents/depositions before mediation and/or after mediation is included in the cost of mediation.

The MMAS tax-identification number is always included in the setting notice sent to all counsel. Should you need a signed W-9 tax form please contact us and a signed copy of a W-9 will be promptly sent by e mail.

Cancellation Policies-Mediation

Mike understands that lawyers and parties have very busy schedules. During the course of litigation unexpected things happen that are beyond everyone’s control. Often times, despite everyone’s best efforts, the parties may not be ready to mediate or it’s not unusual that a case may even settle prior to mediation. MMAS does not charge a cancellation mediation fee if Mike is advised of the cancellation no later than 14 days prior to the start of a scheduled mediation. If the mediation session is cancelled (and not reset) within 14 days prior to a confirmed scheduled mediation, MMAS will bill each party for one-half of the cost of the scheduled session.
