Arbitration Cost, Payment & Cancellation Policies
Cost & Payment Policies
- Administrative Fee: A non-refundable administrative filing fee of $250.00 per party.
- Hourly Charge: $325.00 per hour for all time expended in the administration, pre-hearing study, hearing time, and opinion time (if requested), plus any necessary expenses associated with the proceeding.
- Billing & Awards: Charges are billed monthly. There is no additional charge for an Award. If an opinion is requested, it will be billed at the standard hourly rate.
- Travel & Expenses: Judge Metcalf will arbitrate in any geographical area; travel and incidental expenses for hearing locations are charged separately.
- Release Condition: Arbitration Awards/Opinions are not released until all fees (including additional funds requested for preparation/opinions) are paid in full.
Cancellation Policies
- Within 10 business days: 100% of the invoiced fee for any cancellation within 10 business days of the scheduled arbitration date.
- Within 11 - 15 business days: 75% of the invoiced fee for any cancellation within 11 to 15 business days of the scheduled arbitration date.

Cost & Payment Policies
All mediation fees are due before the mediation begins. Unless otherwise agreed by the mediator, each party represented by a lawyer/law firm is considered a “separate party” and is responsible for its mediation fee. Mike reserves the right not to begin or conduct a mediation if the fees are not paid.
Preparation time Mike spends discussing the case with counsel/parties and reviewing documents/depositions before or after mediation is included in the cost of mediation.
Mediation Session Rates
Full Day Mediation
Begins at 9:00 AM (unless agreed otherwise). Lunch included. Continuances after 6:00 PM billed at $275/hour divided equally.
Half Day Mediation
Available slots: 9:00 AM – 1:00 PM or 1:30 PM – 5:30 PM.
Two Hour Mediation
Available slots: 9:00 AM–11:00 AM, 11:00 AM–1:00 PM, or 2:00 PM–4:00 PM.
Two Hour “Wrap Up”
Round Two wrap-up session available to help settle unresolved disputes.
Cancellation Policies
MMAS understands that schedules change and cases may settle prior to mediation. MMAS does not charge a cancellation fee if advised no later than 48 business hours prior to the start of mediation.
Monday Session Notice Rule
If the mediation is scheduled for a Monday, you must notify MMAS no later than 9:00 AM on the Thursday preceding the mediation to avoid a cancellation expense. Cancellations within 48 business hours of a confirmed mediation will be billed for one-half of the scheduled session cost.

Our office is conveniently located near the Northpark Center shopping area of Dallas, at 10000 N. Central Expressway, Suite 400, Dallas, TX 75231. Visitor parking is complimentary.
The MMAS tax-identification number is always included in the setting notice sent to all counsel. Should you need a signed W-9 tax form, please contact us and a signed copy will be promptly sent by email.
